Residence for family members of Spanish citizens

If your partner, your child or your father or mother is Spanish, there is a dedicated route for you to live and work legally in Spain.

We support you throughout the process: we study your case, prepare the evidence of your family relationship and file the application.

What is this permit?

It is a temporary residence permit for foreign nationals (from outside the EU, the EEA or Switzerland) who have a family relationship with a Spanish national and accompany or join them in Spain.

Since the Immigration Regulation in force from May 2025, family members of Spanish citizens have their own procedure, separate from that for family members of other European Union citizens.

Who can apply?

Partner

  • Spouse over 18, except in cases of annulment, divorce or sham marriage.
  • Registered partner over 18, registered in a public register of an EU or EEA country or of Switzerland.
  • Unregistered stable partner: proof of living together as a couple for at least 12 continuous months, in or outside Spain. This period is not required if you have children together.

Children and other relatives

  • Children (your own or your partner's) under 26, or older if they are dependants or have a disability requiring support.
  • First-degree ascendants (your own or your partner's) who are dependants and have no family support in their country of origin, or where there are humanitarian reasons.
  • Father, mother or guardian of a Spanish minor who is in charge of the child and lives with them or is up to date with their obligations.
  • A relative up to the second degree who cares for a Spanish national with a recognised dependency.
  • Children of a father or mother who was Spanish by origin, in any circumstances.
  • Other relatives who can reliably prove that they are dependants of the Spanish national.

Main requirements

  • A genuine family relationship

Maintaining the family relationship with the Spanish national and accompanying or joining them in Spain.

  • No criminal record

In Spain and in the countries where you have lived in the last 5 years.

  • Not being an EU citizen

Not holding the nationality of an EU or EEA country or of Switzerland, and not being within a period of a commitment not to return to Spain.

Advantages of this route

5 years

A long-term permit

If you are in Spain, the permit is valid for five years from the date it is granted (or for the planned period of residence of your Spanish relative, if shorter).

From the application

You can stay and work

Filing the application gives you the right to stay in Spain while it is processed. Spouses, partners and children may also work during that time.

How we work at Migragest

  1. Case study

We analyse your relationship and the route that applies to you: marriage, registered partnership or stable partnership.

  2. Evidence of the relationship

We prepare and review the evidence of your relationship and of living together, which is where most applications fail.

  3. Filing the application

We file the application and keep you informed at every step.

  4. Follow-up until the TIE

We deal with any requests for documents and support you until you obtain your card.

Is your relative from another EU country?

If your relative is a citizen of another European Union country, the EEA or Switzerland, the procedure is different: see Family reunification for EU citizens.

Is your partner or family Spanish?

Every case needs its own evidence and strategy. We review yours with lawyer Yanet Ramos.
